Terms of Service

By accessing or using The Travel Club platform at thetravelclub.ai ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform. These Terms apply to all visitors, members, and others who access or use the Platform. By creating an account or using our services, you represent that you are at least 18 years of age and have the legal capacity to enter into a binding agreement.

The Travel Club offers free membership to individuals who register on the Platform. Membership grants access to privately negotiated hotel rates, experience bookings, and other member benefits as described on the Platform. Membership is personal and non-transferable. You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at info@thetravelclub.ai if you suspect unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent purposes.

When you make a booking through the Platform, you enter into a contract directly with the hotel or service provider. The Travel Club acts as an intermediary and is not a party to the contract between you and the provider. Rates displayed are member rates negotiated on your behalf. Final pricing including applicable taxes and fees will be shown before you confirm a booking. We do not add hidden fees beyond what is displayed at checkout. Cancellation policies are set by individual hotels and service providers. These policies are displayed clearly before you confirm your booking. The Travel Club is not responsible for cancellation fees charged by providers.

You agree not to use the Platform to: • Circumvent or attempt to circumvent member rate restrictions (e.g., reselling bookings made at member rates) • Submit false, misleading, or fraudulent information when registering or booking • Scrape, copy, or redistribute rate information or hotel inventory data • Interfere with the security or integrity of the Platform • Violate any applicable laws or regulations Violation of these prohibitions may result in immediate account termination and potential legal action.

All content on the Platform — including text, graphics, logos, and software — is the property of The Travel Club or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from Platform content without our express written permission.

The Platform is provided "as is" without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses. Hotel and service provider information (descriptions, photos, amenities) is provided by third parties. While we make reasonable efforts to verify accuracy, we cannot guarantee that all information is current or complete.

To the maximum extent permitted by applicable law, The Travel Club shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or any bookings made through it. Our total liability to you for any claim arising from these Terms or your use of the Platform shall not exceed the amount you paid to us in the twelve months preceding the claim.

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Orange County, California.

We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page. Continued use of the Platform after changes constitutes acceptance of the revised Terms. For material changes, we will make reasonable efforts to notify registered members by email.
